Michael Cordova Obtained A $700,000.00 Dollar Settlement For A Construction Worker Injured At Work.

On August 18, 2005, German Escobar was leading a landscaping crew on a construction project when he was asked by the superintendent of the General Contractor, Porter Brothers, to assist in lifting a huge wall. He was injured in the process of lifting the wall due to the negligence of the Porter Brothers. Our legal team filed a lawsuit against Porter Brothers and obtained a Settlement of $700,000.00 for Mr., Escobar.

Mr. Escobar's Accident and Injuries

As Mr. Escobar was assisting Porter Brothers in lifting the wall, other workers dropped their side of the wall and it collapsed on top of Mr. Escobar. He was a victim of a construction company not taking the proper safety precautions and using inadequate manpower when conducting this dangerous task.

Mr. Escobar suffered serious injuries when the 1100 pound wall fell on top of him. On the day of the accident he was taken to Chandler Regional Hospital by ambulance, where he was diagnosed as having a simple fracture. After being treated at the hospital German received follow up care from other physicians. Several months after the accident, Mr. Escobar was still experiencing severe back pain and had an evaluation with an orthopedic surgeon. The surgeon discovered that German was in fact suffering from a much more serious burst fracture in his back.

The surgeon recommended surgery in order to help alleviate his pain. This was a very invasive and risky procedure. The surgeon informed Mr. Escobar that there was a chance that he could suffer from nerve injuries, wound infections, and there was a chance that the surgery may not help his pain or possibly even make it worse. During the surgery the surgeon had to remove one of German's ribs to enter the chest cavity in order to place a two titanium rods, and screws in his spine. Even after the surgery, the doctors found that Mr. Escobar's spine was 20% impaired, and that this would remain with him for the rest of his life.

Even after all he had gone through, German did attempt to return to work at his employment as a landscaper. His employer could not accommodate Mr. Escobar's light duty restrictions, and he was thus terminated. Mr. Escobar was unable to work in any heavy labor type of jobs, and with only a sixth grade education it was very difficult for him to find a job to support his family.

Mr. Escobar Hired the Law Offices of Michael Cordova

German and his family knew right away that they were facing great difficulties in dealing with the insurance companies and the party responsible for his injuries. Furthermore, they were concerned about Mr. Escobar receiving the proper medical treatment. Mr. Escobar contacted the Law Office of Michael Cordova to help him with his case.

The Legal Fight and $700,000.00 Settlement

This was a complex matter as the defendant construction company was arguing contributory negligence, claiming that Mr. Escobar was responsible for his injuries. Also, for a variety of reasons the construction company did not want to adequately compensate Mr. Escobar for his future lost wages. Michael Cordova P.C. assembled a team of legal and medical experts to overcome these and many other obstacles in securing Mr. Escobar a settlement of $700,000.
