In Phoenix, Arizona, it is estimated that as many as 40% of all vehicles on the road do not have automobile insurance.  If you are involved in an auto accident and the other driver is at fault but they do not carry any automobile insurance or carry enough insurance, what are you able to do?

Under Arizona law, all automobile insurance companies must offer uninsured motorists (UM) and underinsured motorist coverage (UIM) to every policyholder. These coverages provide protection when an at-fault driver does not have any insurance coverage, or not enough insurance coverage. These coverages are so important that if you elect not to have them, your insurance agent, under Arizona law, must obtain your signature on a declaration page indicating that you have elected not to have these coverages.

Under Arizona law, automobile owners and drivers must possess at least 15/30 coverage.  That means that the insurance company will provide coverage of up to $15,000 for any one claim, but not more than $15,000; and up to $30,000 of coverage for all claims arising out of the accident.  These limits apply even if there are serious injuries or even wrongful death occurring in the accident; the insurance company will not pay any amounts above the policy limits.

The best way to protect oneself and your family is to select uninsured motorists and underinsured motorist coverage on your own insurance policy.  Normally it is extremely reasonable in cost – around 30 cents  per day.  But, most importantly, it protects you, your family, and the passengers in your vehicle when an at-fault driver does not have any insurance coverage or insufficient insurance coverage.
