U.S. Supreme Court to hear vaccine case

For most of their 18-year-old daughter Hannah’s life, Russell and Robalee Bruesewitz have been engaged in legal battle over compensation for her seizure disorder, which they believe was caused by a vaccine.

 

On Monday, the Mt. Lebanon family learned that they’ll be taking their fight to the highest level.

 

The U.S. Supreme Court announced that it will hear their case, in which the family argues that there should be legal recourse beyond the administrative process set up by the National Childhood Vaccine Injury Act.

L.A. settles accident lawsuit for $7 million

The city of Los Angeles paid $7 million to settle a lawsuit brought by a volunteer for the Los Angeles Triathlon, who was left a paraplegic by an accident during the event in 2007, his attorney said Monday.

 

Steve Albala, who was 60 at the time of the accident, was on his motorcycle helping to officiate the bicycle portion of the triathlon. A traffic officer motioned for a vehicle to enter an intersection into the volunteer’s path, causing the accident, Albala’s attorney contended in the lawsuit.

Judge ends 26 years of special education oversight for city schools

Saying that Baltimore’s schools have made great strides in the past several years toward providing better teaching to special education students, a federal judge ended 26 years of oversight of the school system and paved the way for a final settlement in two years.

 

U.S. District Court Judge Marvin Garbis accepted an agreement from the parties in a lawsuit that began in 1984 when the Maryland Disabilities Law Center filed suit on behalf of several special education students saying they were not being offered adequate services.

Cranberry couple sues Target after trunk injures toddler

A Butler County couple on Monday filed a lawsuit against Target, claiming that an improperly marketed wicker trunk that they used as a toy chest trapped their 18-month-old daughter’s neck, leaving her in a persistent vegetative state.

 

Eric and Laura Surman, of Cranberry, allege that Target should either have made the chest safe by inserting a lid support in it, or labeled it as inappropriate for use as a child’s toy box.

 

The family is seeking punitive damages and cites Target’s blatant disregard for safety.

Sacramento jury awards record $24.3 million to girl run over by dad’s truck

An Oregon girl whose truck-driver father accidentally ran her over with his big rig has won $24.3 million in damages from the Portland company that a Sacramento judge found legally responsible for her injuries.

 

The personal-injury award handed down by a Superior Court jury last Friday to Diana Yuleidy Loza-Jimenez is the largest in Sacramento County history, according to the local bar association.
