Lawsuit attacks patent giving company control over genetic test for cancer risk

After receiving a diagnosis of aggressive breast cancer at age 43, Lisbeth Ceriani wanted to find out whether she had the BRCA gene mutation, which makes women much more likely to get breast and ovarian cancer. If she tested positive for the mutation, she decided, she would have her ovaries removed preemptively.

 

But Massachusetts, where Ceriani lives, is one of 24 states where Medicaid does not cover the $3,120 test, which is offered only by the Utah biotech company Myriad Genetics. Coordinator of a Boston au pair program where she does not get health insurance or earn enough to purchase it on her own, Ceriani said she could not afford the test. She is one of the plaintiffs in a lawsuit claiming that Myriad’s exclusive right to conduct tests for the mutation is unconstitutional.

Jeffco, Colorado Springs school districts join lawsuit over state funding

School districts in Jefferson County and Colorado Springs have joined a lawsuit on whether the state provides enough funding to public schools.

 

The development throws the weight of two major school districts behind the lawsuit, a case that could force the state to spend far more on schools as well as potentially challenge the Taxpayer’s Bill of Rights in the state constitution.

 

Parents of children in Denver Public Schools also have joined in the suit.

Alamosa sued over salmonella in drinking water

Twenty-nine families afflicted by the salmonella outbreak in Alamosa’s water supply sued their city government Monday.

 

The plaintiffs include the widow of 54-year-old Larry Velasquez, who died after salmonella bacteria infected his bloodstream.

 

“He was running a high fever,” said his daughter, Anna Velasquez. “He couldn’t eat anything. His stomach was upset, throwing up all the time. He had diarrhea.”

 

An Alamosa hospital gave him a shot for nausea and sent him home, she said. Finally, she and her mother took him to a hospital in Pueblo, which found the salmonella infection.

Family settles suit against nursing homes

MISSOULA — After nearly a full week of trial, a Missoula family and two nursing homes settled a wrongful death case out of court this week, coming to terms that were “agreeable to all parties,” according to a statement from attorneys in the case.

 

All matters against the nursing homes have been dismissed, though neither party can disclose the settlement amount because those terms are confidential.

Lawsuit planned over extractions by CU dental school

A lawyer has served notice that she intends to sue the University of Colorado dental school on behalf of a patient so severely developmentally disabled she can’t sign her name, alleging 13 of the woman’s 14 teeth were pulled without her caregiver’s consent.
