Fifth Third sued over overdraft policies

A class action lawsuit filed Monday in a federal court in Georgia seeks to force Fifth Third Bank to refund what the suit claims are hundreds of millions of dollars in unlawful overdraft charges.
The lawsuit was filed on behalf of Marlene Willard of Hephzibah, Ga., by the Washington, D.C.-based law firm Tycko and Zavareei LLP. The suit claims that Willard and other bank customers were unfairly and illegally charged overdraft fees by Fifth Third Bancorp for charges they made on their ATM/debit cards.

Atlanta firefighters sue pension custodian over ‘risky investments’
Atlanta firefighters’ pension fund has sued the custodian managing its plan, saying it made several risky investments that could cost them about $1 million.
The lawsuit claims that Chicago-based Northern Trust breached its contract and fiduciary duty with mortgage-backed securities investments that ignored the warnings of the company’s chief economist. The Chicago Public School Teachers’ Pension and Retirement Fund joined in the lawsuit, which was filed Jan. 29 in federal court in Chicago.

Bar, landscaping firm named in wrongful death lawsuit
An illegal immigrant and convicted murderer in a state prison, a landscaping firm and its owners, and a bar are all named in a wrongful death suit filed in Bucks County Court.
Jose Esteban Maldonado-Luzuriaga, 36, is serving a 20- to 40-year sentence for murdering William Sullo III in 2008. Maldonado-Luzuriaga, an illegal immigrant without a driver’s license, ran down Sullo outside a Bensalem bar where Sullo worked because bar employees stopped serving him alcohol. He was driving his employer’s Green Tree Landscape Service pickup at the time.

Christ Hospital settles whistleblower suit in kickback scheme
Christ Hospital has settled a federal whistleblower lawsuit accusing its acclaimed cardiac-care center of running an illegal kickback scheme.
Christ and fellow defendant the Health Alliance of Greater Cincinnati will pay millions to end the lawsuit, and retired cardiologist Harry Fry, who filed suit in 2003, stands to gain millions in the settlement.

S.C. State, Hugine resolve lawsuit
South Carolina State University and Andrew Hugine, its former president, have resolved a multimillion-dollar lawsuit that he filed after the school’s Board of Trustees decided not to renew his contract, effectively firing him.
S.C. State, in a news release Wednesday, said the lawsuit was resolved with a stipulation of dismissal with prejudice, which will forever end litigation in the matter.
