Legally, doctor is under no limits

Despite the deaths of three patients and numerous examples of alleged prescription drug malpractice, Dr. Kevin Buckwalter is still allowed to see patients in Nevada.

 

Investigations of Buckwalter are continuing, but the Nevada State Medical Examiners Board has not suspended his license or taken any steps to force him to curtail his prescribing of large quantities of narcotic painkillers. The lack of action is coupled with regulations that prevent pharmacists from refusing to fill suspicious prescriptions.

 

The situation reveals major flaws in the state system of overseeing doctors, said Assemblywoman Sheila Leslie, D-Reno, chairwoman of the Legislative Health Care Committee.

 

Nevada’s “medical regulatory system has to be entirely reformed,” Leslie said.

Lilly to take $1.41B charge on Zyprexa

Indianapolis drugmaker Eli Lilly and Co. said it is in “advanced discussions” to settle an investigation by U.S. and state authorities over the antipsychotic Zyprexa and will take a $1.415 billion charge in the third quarter. The charge will amount to $1.29 a share, Lilly said in a news release this morning.

 

The government’s investigation is related to past marketing and promotional practices for Zyprexa; Lilly has said its current methods are in line with all laws and regulations.

Zyprexa, one of Lilly’s biggest-selling drugs since its introduction in 1996, has also been costly to the company. Most recently the company paid $15 million to settle a lawsuit with the state of Alaska. On Oct. 7, the company resolved a 32-state claim over sales, marketing and promotion of Zyprexa for $62 million.

Car dealership customers eligible for $1,200 in lawsuit settlement

Customers who bought refundable service contracts for parts and repairs from John Chezik Honda will be eligible to receive at least $1,200 apiece under a settlement reached last week.

 

The settlement calls for the dealership, which filed for Chapter 7 bankruptcy in December, to pay $2.88 million into the bankruptcy estate to cover the customers’ damages and $2.5 million to cover attorneys’ fees and expenses.

The agreement ends litigation that dates back more than six years, when Gladstone residents Keith and Deborah Shackleford sued the dealership in Clay County Circuit Court for fraud, breach of contract and violations of the Missouri Merchandising Practices Act.

 

The case was later certified as a class action covering Chezik customers who bought vehicle service contracts between Jan. 1, 1997, and Dec. 22, 2003.

Customers paid more than $1,000 apiece for the vehicle service contracts, which were supposed to cover the costs of various parts and repairs for three years or 36,000 miles, whichever came first. The customers were told that if they didn’t use the contract during the contract period, the price of the contract would be refunded.

Mom files lawsuit in cheerleader’s ’05 death

Three years after her 14-year-old daughter died from a ruptured spleen suffered while performing a cheerleading stunt, Ruth Burns says she continues to live her own “worst nightmare.”

 

She claims she still can’t work, needs medication to get through the day and sleep, and sees a psychologist weekly.

 

“I’m an extreme mess,” said Burns, now 37 and childless. “If I did not have the cat and three dogs, I probably wouldn’t get up every day. Ashley was my world, and my world is now gone.”

 

Yesterday, the Medford woman filed a wrongful death lawsuit against the East Elite Cheer Gym, the Tewksbury facility where her daughter was receiving instruction with the Medford High School cheerleading team when she suffered her fatal injury.

Suit filed in Downstate crash that killed Chicago student

A wrongful-death lawsuit has been filed by the parents of a Chicago woman killed on Interstate Highway 57 when a driver of a reality show on the VH1 cable network apparently fell asleep, crossed the median and slammed into the vehicle in which she was riding.

Kevetta Davis, 19, died Sept. 26 after being struck by a truck driven by Dennis Hernandez, who was hauling sound equipment for “Rock of Love With Bret Michaels.” The crash near West Frankfort, about 20 northeast of Carbondale, also killed Yasmin Jackson, 19, Davis’ friend and a fellow student at Southern Illinois University. The lawsuit, filed in Cook County Circuit Court, names Viacom Inc., VH-1 Music First, 51 Minds Entertainment LLC and Hernandez as defendants.
