Lawyer Indicted for Forging Will of Brother Killed in Plane Crash

A well-known Allentown, Pa., lawyer was indicted by a federal grand jury last week on charges of fabricating wills to add himself as a beneficiary after his brother, also a lawyer, and sister-in-law were killed in a February 2007 plane crash.
The indictment charges that attorney John Karoly Jr., 58, conspired with his son, John “J.P.” Karoly III, 28, and a doctor, John J. Shane, 72, to present fake wills in Northampton County Orphans’ Court that showed Shane as the sole witness.

Erin Brockovich Working for Small N.Y. Law Firm
The legal crusader portrayed by Julia Roberts in the Oscar-winning film “Erin Brockovich” is now working for a Manhattan personal injury law firm that specializes in asbestos cases.
The real Erin Brockovich signed a consulting contract with Weitz & Luxenberg and will be involved in soliciting cases and investigating claims. Brockovich told the New York Post: “I’m hands-on and they’re hands-on so it will be a team effort.”

Judge Rejects Commercial Free Speech Defense in ‘Off-Label’ Drug Promotion
A pharmaceutical company sales representative accused of promoting a “powerful sleep-inducing depressant” for “off-label” uses is not entitled to dismissal of the case on free-speech grounds, a federal judge in Brooklyn has ruled.
Even though such speech is not “inherently” misleading, Eastern District Judge Eric N. Vitaliano held that Alfred Caronia’s prosecution for violating the Food, Drug and Cosmetic Act did not amount to an unconstitutional restriction on commercial speech.
In addressing what he characterized as “unsettled” constitutional issues, the judge held in United States v. Caronia, 06-CR-229, that the government’s ban on manufacturers’ promotion of off-label drug uses “appear[s] essential to maintaining the integrity of the [U.S. Food and Drug Administration]‘s new drug approval process.”
According to Caronia’s motion to dismiss, he was hired by Orphan Medical Inc. in March 2005 to sell Xyrem, a prescription medication used to treat narcolepsy.

Older Problem Gamblers Face Increased Suicide Risk
Older problem gamblers who ask to be barred from casinos are three to four times more likely than younger gambling addicts to do so because they’re afraid they’ll commit suicide if they don’t stop betting, according to a new study.
The study included 1,601 compulsive gamblers who, between 2001 and 2003, asked to be banned from Missouri casinos. On average, those age 55 and older had gambled for 17 years before “self-exclusion,” more than twice the length of time reported by younger gamblers.
Gamblers of all ages cited gaining control, needing help, and hitting rock bottom as their primary reasons for seeking self-exclusion. But 14 percent of older gamblers said they sought help because they wanted to prevent themselves from committing suicide. That’s a far higher rate than in any other age group, the study found.
