"Executions drop in ’07 as states rethink death penalty"

WASHINGTON (CNN) — A day after New Jersey banned executions, newly released figures show that capital punishment dropped this year to a 13-year low.
Forty-two people have been put to death this year, according to the Death Penalty Information Center (DPIC), a Washington-based group that opposes the practice. That figure is down 57 percent from what it was in 1999, when 98 inmates were executed.
Next year’s figures are expected to drop further. The Supreme Court is to hold oral arguments January 7 about whether lethal injection protocols in 36 of the 37 states with the death penalty are constitutional.

PORTLAND, Ore. — On a motion to reconsider a July 2006 order reinstating a personal injury class action lawsuit against the U.S. Department of Housing and Urban Development and the Blackfeet Tribal Housing Authority for exposure to chemicals in pressure treated wood, a divided panel of the Ninth Circuit U.S. Court of Appeals held that the federal government did not undertake a trust relationship with the plaintiffs to construct or maintain the housing (Martin Marceau, et al v. Blackfeet Housing Authority, et al., No. 04-35210, 9th. Cir.; 2008 U.S. App. LEXIS 18028).
