Arizona Wrongful Death Lawsuit
A Wrongful Death lawsuit can be brought against negligent parties whose actions lead to the wrongful death of a family member. Filing a wrongful death lawsuit against a negligent party is a civil action which allows family members to receive compensation for the loss of a loved one. Two Different Wrongful Death Claims
In Arizona, there are two separate wrongful death claims that can be pursued:
First, the estate of the deceased has a wrongful death claim for losses arising before death, such as medical bills and injury and suffering. The estate can also recover the expected contribution they would have obtained from the employment of the deceased family member.
The second claim available in an Arizona wrongful death case belongs to the close survivors of the deceased. By law, these close familial members of the victim include a deceased loved one's children, parents, or spouse. Items which surviving family members can receive compensation include:
